Terms of Service

These Terms of Service govern your use of the ProFuturesTrading website (profuturestrading.de) and the indicator tools and content offered through it. By subscribing to or using our tools, you agree to these terms.

1. Provider

2. Products & License

Our products are software indicators for the ATAS Order Flow Trading Platform, offered as monthly subscriptions. A subscription grants you a non-exclusive, non-transferable license to use the tools within your own ATAS account for the duration of the active subscription. Reselling, redistributing, decompiling, or sharing the tools is prohibited.

3. Ordering & Payment

Purchases through ablefy.New purchases are made through the ablefy checkout (checkout.profuturestrading.de). Your contractual partner for these purchases is namotto Universal Brands GmbH & Co. KG, Potsdamer Straße 125, 10783 Berlin, Germany (customer service: info@namotto-ub.com). The terms of namotto apply to the purchase; these Terms of Service apply in addition, as stated at checkout.

Subscriptions bought through CopeCart. Subscriptions that were bought through CopeCart continue to be processed by our reseller CopeCart GmbH as merchant of record. For these, the contract for the purchase was concluded with CopeCart at checkout; their terms and billing apply to the payment transaction.

Which of the two applies depends on where you paid: on the ablefy checkout (checkout.profuturestrading.de) or at CopeCart. Prices are shown net; applicable VAT is added at checkout.

4. Activation

Licenses are activated automatically via the ATAS account email address you enter at checkout. Activation typically occurs within seconds. It is your responsibility to enter the correct ATAS-linked email.

5. Subscription Term & Cancellation

Subscriptions renew automatically each billing period until cancelled. You may cancel at any time, effective at the end of the current paid period. For purchases through ablefy, you can cancel through the ablefy cancellation page (also linked as "Cancel subscription" at the bottom of the checkout). For subscriptions bought through CopeCart, cancellation is handled through your CopeCart purchase confirmation / customer portal. In either case you can also cancel on our cancellation page.

6. Right of Withdrawal & Refunds

Consumers generally have a statutory 14-day right of withdrawal. The purchase contract is concluded with your contractual partner (section 3): namotto Universal Brands GmbH & Co. KG for purchases through ablefy, CopeCart GmbH as merchant of record for subscriptions bought through CopeCart. The formal withdrawal instruction, including the model withdrawal form required by law, is provided by that contractual partner during checkout; for purchases through CopeCart it is also included in your order confirmation.

Our tools are digital content delivered immediately upon subscription. For subscriptions bought through CopeCart, you were asked during checkout to expressly consent to immediate access and to confirm that you thereby lose your statutory right of withdrawal once performance has begun (§ 356 para. 6 no. 2 German Civil Code / Art. 16(m) Consumer Rights Directive); without this consent, access began only after the withdrawal period had expired. On the ablefy checkout you are asked to expressly request that performance begins before the withdrawal period expires and to agree to waive your right of withdrawal, as worded there; the withdrawal instruction of namotto applies.

Beyond the statutory rights, we do not offer voluntary refunds. Subscriptions bought through ablefy do not include a free trial: the first billing period is charged at purchase. Subscriptions bought through CopeCart started with a 5-day free trial that let you evaluate the tools in full before any payment was due. In both cases the subscription is billed monthly. You can cancel at any time; cancellation takes effect at the end of the current billing period, and you keep full access to the tools until that period ends.

7. No Financial Advice / Risk Disclaimer

RISK DISCLAIMER: All ProFuturesTrading tools are analytical decision-support instruments for educational and informational purposes only. They do not constitute financial advice, investment recommendations, or trading signals. They do not guarantee profitability and do not replace a trading plan, risk management, or independent decision-making. Trading futures, forex, and cryptocurrency involves significant financial risk and may not be suitable for all traders. Past performance is not indicative of future results. Only trade with capital you can afford to lose.

The tools are analytical decision-support instruments only. They do not execute trades, do not provide buy/sell signals as financial advice, and do not guarantee any result. All trading decisions are made solely by you and at your own risk.

8. Availability & Platform Changes

We aim for high availability but do not guarantee uninterrupted operation of the tools, the ATAS platform, or third-party data feeds. Maintenance, updates, or third-party outages may temporarily affect availability.

The tools depend on the ATAS platform and its marketplace infrastructure, which we do not control. If a change to ATAS permanently prevents a tool from functioning and we are unable to restore functionality within a reasonable time, you may terminate the affected subscription with effect from the end of the current billing period; no further payments fall due for the affected tool. Further claims are governed by section 9.

9. Limitation of Liability

To the extent permitted by law, we are liable without limitation only for intent and gross negligence, and for injury to life, body, or health. For slight negligence we are liable only for breach of a material contractual obligation, limited to the foreseeable, typical damage. Any liability for trading losses is excluded.

10. Governing Law

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of residence remain unaffected.

11. Consumer Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. EdgeBook Trading Journal & AI Connector

In addition to our ATAS indicators, we offer EdgeBook, a desktop trading journal (part of the PFT Terminal), with optional cloud sync and an optional AI Connector. Access to the cloud and AI features requires an active account and the corresponding subscription / entitlement. Sections 3 to 6 (ordering, payment, cancellation, withdrawal) apply to any paid EdgeBook plan in the same way as to our indicators.

AI Connector (read-only).The EdgeBook AI Connector lets an AI assistant of your choice (e.g. Claude or ChatGPT) read your own journal over the Model Context Protocol. It is strictly read-only: it cannot create, change or delete data. You are responsible for keeping your login and any connected AI client secure, and you must not attempt to access other users' data or circumvent the security of the service.

AI output. Insights are generated by a third-party AI that you connect and that processes your data under its own terms. AI output can be inaccurate or incomplete and does not constitute financial, investment, tax or legal advice (see section 7). You must independently verify anything you rely on; we are not responsible for the content produced by your chosen AI provider.

13. Changes to These Terms

We may update these terms where necessary. The version in force at the time of your purchase applies to that purchase.
